Terms of Service

2.1 Agreement to Terms. By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

2.2 Legal Capacity. You represent and warrant that you are at least 18 years of age or have reached the age of majority in your jurisdiction, and have the legal capacity to enter into binding agreements under Latvian law (Latvijas Republikas Civillikuma 1405. pants).

2.3 Parental Consent. If you are between 13 and 18 years of age, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2.4 Modifications. We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our website at least 30 days before taking effect, in accordance with Article 6 of the Latvian Consumer Rights Protection Law.

2.5 Continued Use. Your continued use of the Services after any modifications to these Terms constitutes acceptance of those modifications.

3.1 Core Services. BSEC.LV provides DNS resolution services with integrated security features including:

• Privacy-focused DNS resolution via standard DNS, DNS-over-HTTPS (DoH), and DNS-over-TLS (DoT)
• Configurable content filtering and ad blocking
• Malware, phishing, and ransomware domain blocking
• Custom allowlist and blocklist management
• Optional DNS query analytics and logging
• DNSSEC validation for domain authenticity

3.2 DNS Endpoints. Our DNS services are accessible at:

• Primary DNS: 185.228.168.10
• Secondary DNS: 185.228.168.11
• DoH: https://dns.bsec.lv/dns-query
• DoT: dns.bsec.lv (Port 853)

3.3 Service Availability. We strive to maintain 99.9% service availability. However, we do not guarantee uninterrupted service and may perform maintenance with reasonable notice. Emergency maintenance may occur without prior notice.

3.4 Free Tier Limitations. Free Tier accounts are limited to one (1) DNS profile with basic filtering capabilities. Advanced features require a paid Subscription.

3.5 No Warranties. The Services are provided "as is" and "as available" without warranties of any kind, except as required by mandatory Latvian consumer protection laws.

4.1 Registration. To access certain features, you must create an Account by providing accurate, current, and complete information including a valid email address.

4.2 Email Verification. You must verify your email address before gaining full access to the Services. Unverified accounts may have limited functionality.

4.3 Account Security. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your Account
• Notifying us immediately of any unauthorized access
• Using strong, unique passwords and enabling Multi-Factor Authentication (MFA) when available

4.4 One Account Per Person. Each individual may maintain only one Account unless explicitly authorized by us in writing.

4.5 Account Suspension. We reserve the right to suspend or terminate Accounts that violate these Terms, engage in fraudulent activity, or pose security risks.

5.1 Lawful Use. You agree to use the Services only for lawful purposes and in compliance with all applicable laws of the Republic of Latvia, European Union, and your jurisdiction of residence.

5.2 Accurate Information. You agree to provide accurate, truthful, and current information during registration and throughout your use of the Services.

5.3 Security Cooperation. You agree to cooperate with reasonable security measures, including but not limited to:

• Responding to security notifications promptly
• Updating account credentials when advised
• Reporting suspected security incidents

5.4 No Interference. You agree not to interfere with or disrupt the Services, servers, or networks connected to the Services.

5.5 Compliance with DNS Policies. You agree to configure and use DNS profiles in accordance with our Acceptable Use Policy and applicable laws.

7.1 Our Intellectual Property. The Services, including all software, algorithms, designs, trademarks, logos, and content (excluding User content), are owned by SIA BSEC and protected under Latvian and international intellectual property laws, including the Latvian Copyright Law (Autortiesību likums).

7.2 Limited License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

7.3 User Content. You retain ownership of any DNS configurations, custom rules, or other content you create within the Services. By creating such content, you grant us a license to store and process it as necessary to provide the Services.

7.4 Feedback. Any feedback, suggestions, or improvements you provide regarding the Services may be used by us without compensation or attribution.

7.5 Third-Party Components. The Services may include open-source software components subject to their respective licenses. A list of such components is available upon request.

8.1 Subscription Plans. Premium features are available through paid Subscription plans. Current pricing and features are displayed on our website and may change with 30 days notice.

8.2 Payment Processing. Payments are processed securely through Stripe, Inc. By subscribing, you also agree to Stripe's terms of service. We do not store complete payment card details.

8.3 Billing Cycle. Subscriptions are billed in advance on a monthly or annual basis, as selected. All prices are displayed in EUR and include applicable VAT/PVN (21% in Latvia).

8.4 Automatic Renewal. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your Account settings.

8.5 Refunds. In accordance with the Latvian Consumer Rights Protection Law:

• You may withdraw from a Subscription within 14 days of purchase without reason (withdrawal right / atteikuma tiesības)
• To exercise this right, contact us at billing@bsec.lv with your account details
• Refunds will be processed within 14 days using the original payment method
• If you have actively used the Services during the withdrawal period, a proportionate amount may be deducted

8.6 Price Changes. We may change Subscription prices with 30 days advance notice. Price changes take effect at the next billing cycle.

8.7 Failed Payments. If payment fails, we may suspend access to premium features until payment is resolved. We will make reasonable attempts to notify you before suspension.

9.1 Scope of Limitation. To the maximum extent permitted by Latvian law (Civillikuma 1779. pants), our total liability for any claims arising from or related to the Services shall not exceed:

• For Free Tier users: EUR 0 (zero euros)
• For Subscribers: The total amount paid by you in the 12 months preceding the claim

9.2 Exclusions. We shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, business opportunities, or goodwill
• Service interruptions or downtime
• Actions of third parties, including malicious actors
• Content accessed through DNS resolution
• Force majeure events (natural disasters, war, government actions, etc.)

9.3 Consumer Rights. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under mandatory Latvian consumer protection laws, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

9.4 DNS Service Disclaimer. DNS filtering may not block all malicious content. Users remain responsible for implementing additional security measures as appropriate.

10.1 Termination by You. You may terminate your Account at any time by:

• Using the account deletion feature in your dashboard
• Contacting us at support@bsec.lv with a deletion request

10.2 Termination by Us. We may suspend or terminate your Account:

• Immediately for serious violations of these Terms
• With 30 days notice for minor violations or inactivity exceeding 12 months
• If required by law or court order

10.3 Effect of Termination. Upon termination:

• Your access to the Services will cease
• DNS profiles will stop functioning
• We will delete your Personal Data in accordance with our Privacy Policy and GDPR requirements
• Provisions that should survive termination (intellectual property, limitation of liability, governing law) will continue to apply

10.4 Data Export. Before termination, you may request an export of your data in accordance with GDPR Article 20 (right to data portability).

11.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the Republic of Latvia, without regard to conflict of law principles.

11.2 Jurisdiction. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Latvia, specifically the courts of Riga.

11.3 Consumer Rights. If you are a consumer residing in the European Union, you may also bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

11.4 Alternative Dispute Resolution. EU consumers may use the Online Dispute Resolution platform at https://ec.europa.eu/odr. Latvian consumers may contact the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs) at https://ptac.gov.lv.

11.5 Informal Resolution. Before initiating formal proceedings, we encourage you to contact us to attempt informal resolution of any disputes.
